Board Message Regarding APRN Prescriptive Authority

Pursuant to Governor Justice signing HB 214, the following is the current law with regard to APRN prescriptive authority:

§30-7-15a. Prescriptive authority for prescription drugs.​

(a) An advanced practice registered nurse may not prescribe a Schedule I controlled substance as provided in §60A-2-204 et seq. of this code.

(b) An advanced practice registered nurse may prescribe up to a three-day supply of a Schedule II narcotic as provided in §60A-2-206 et seq. of this code.

(c) There are no other limitations on the prescribing authority of an advanced practice registered nurse, except as provided in §16-54-1 et seq. of this code.

For any APRN with prescriptive authority who has not yet exercised prescriptive authority:  Please contact the DEA office at one of the following numbers: 304-347-5210 or 571-362-2223.  The investigator who answers the call will have verification questions for the registrant.   NOTE: Each APRN must make this call individually.  The DEA will not add the Schedule II and III authorization unless YOU make the call.
